What makes Michigan different
Michigan's position is unsettled. Our Terms of Use tell you to treat it as all-party to be safe, and that is how we classify it here.
What you can do instead
- Ask every participant for their agreement before recording, and capture that agreement at the start of the call.
- If the call is with someone in a one-party consent state and you are the one in Michigan, the stricter Michigan rule still applies to you.
- Where a written record is what you actually need, contemporaneous notes confirmed by email afterwards carry weight without touching recording law at all.
When the other person is in another state
Consent rules follow the people on the call, not the number you dialled. If any participant is sitting in an all-party consent state, treat the call as all-party and get everyone's agreement first — whatever the rule is where you are. These are the jurisdictions that require it:
